  1. General Terms

Welcome to Marv’s Precious Metals & Collectibles (“Marv’s,” “we,” “us,” or “our”).

We are a Canadian-owned precious-metals and collectibles retailer operating in Alberta, Canada.

By accessing our website or placing an order, you agree to these Terms and Conditions, subject to applicable Canadian federal and provincial laws.

These terms apply to purchases of gold, silver, bullion, coins, bars, collectibles and other merchandise offered through our website.

Nothing in these terms limits any rights or remedies that cannot legally be excluded under applicable consumer protection legislation.

  1. Currency and Product Pricing

All prices displayed on our website are in Canadian dollars (CAD), unless otherwise stated.

Gold and silver prices may fluctuate based on international precious-metal markets, currency exchange rates, product availability and dealer premiums.

We use market-based pricing for certain products. Prices may change without advance notice.

The price displayed when an order is submitted is subject to confirmation and acceptance by Marv’s.

If a technical malfunction, incorrect market-data feed, typographical error or other genuine pricing error occurs, we may contact the customer to resolve the error or cancel an unaccepted order and refund any payment received.

Any cancellation or price correction will comply with applicable consumer protection laws.

  1. Order Placement and Acceptance

Submitting an order through our website constitutes an offer to purchase the selected products.

An automated order acknowledgment does not necessarily constitute acceptance of that offer.

An order is accepted when we expressly confirm acceptance or otherwise fulfil it.

We reserve the right to decline an order for legitimate reasons, including unavailable inventory, suspected fraud, payment verification issues, legal restrictions or genuine pricing errors.

If we cannot fulfil an accepted order, we will contact the customer and provide the remedies required by applicable law.

  1. Payment Methods

Marv’s Precious Metals & Collectibles offers the following payment options where available at checkout:

  • Interac e-Transfer
  • Bank wire transfer
  • Cash, for approved in-person transactions
  • Credit and debit cards
  • Apple Pay and Google Pay, where supported

The applicable payment price will be displayed before the customer completes the order.

Products may display separate prices for e-Transfer, wire transfer or cash and for card-based payment methods.

Card, Apple Pay and Google Pay prices may be approximately 4% higher than the corresponding e-Transfer, wire transfer or cash prices, as disclosed at checkout.

All payment pricing and charges are subject to applicable laws, payment-network rules and processor agreements.

Orders may be held until payment has been received, cleared and verified.

Customers are responsible for bank or transfer charges imposed by their own financial institutions.

  1. Bullion Sales, Returns and Cancellations

Precious metals are subject to continuous market-price fluctuations.

Accordingly, all sales of gold and silver bullion, including bullion coins, bars and rounds, are intended to be final once an order has been accepted, except where cancellation, refund, replacement or another remedy is required by applicable law.

Change-of-mind returns are generally not accepted for bullion products.

Customers should carefully review their orders before submitting payment.

This policy does not eliminate statutory rights relating to defective, incorrectly described, undelivered or otherwise non-conforming goods.

If an order arrives damaged or incorrect, customers should contact us promptly with their order number and supporting photographs so that we can investigate and arrange an appropriate remedy.

  1. Shipping and Delivery

Marv’s currently ships orders to eligible addresses within Canada only.

Shipping costs and available delivery methods are provided during checkout or communicated before the purchase is finalized.

Where advertised or purchased, shipments will include insurance subject to the applicable insurance terms and coverage limits.

Orders may require a signature upon delivery.

We may require additional verification for high-value orders or arrange secure pickup where appropriate.

Delivery estimates are not guaranteed unless expressly agreed.

Responsibility for goods during shipment, and any transfer of risk or ownership, will be determined according to applicable law and the agreed delivery terms.

Customers must provide accurate shipping information and cooperate with reasonable delivery and insurance-claim procedures.

Nothing in this section removes our legal responsibility for goods lost or damaged before delivery where that responsibility cannot lawfully be excluded.

  1. Taxes

Applicable Canadian taxes are calculated according to the nature of the product, the delivery destination and relevant federal or provincial tax laws.

Qualifying investment-grade precious metals may be exempt from GST/HST.

For Canadian GST/HST purposes, qualifying precious metals generally include eligible gold and platinum of at least 99.5% purity and silver of at least 99.9% purity, provided the other statutory requirements are met.

Collectibles, jewellery, accessories and certain other products may be taxable even where they contain precious metals.

Applicable taxes will be disclosed during checkout.

  1. Anti-Money Laundering and Customer Verification

Marv’s Precious Metals & Collectibles is committed to complying with applicable Canadian anti-money laundering, anti-terrorist financing and sanctions laws.

These include, where applicable, the Proceeds of Crime (Money Laundering) and Terrorist Financing Act and its regulations.

We may request government-issued identification, proof of address, transaction information, source-of-funds information or other documentation where required by law or reasonably necessary for fraud prevention and compliance.

Certain transactions, including qualifying large cash transactions and suspicious transactions, may trigger recordkeeping, identity-verification or reporting obligations to the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC).

Not every purchase of $10,000 or more automatically requires a transaction report. Reporting obligations depend on the circumstances and applicable legal requirements.

We may refuse, delay or cancel transactions where legally permitted or required for compliance or security reasons.

  1. Selling Precious Metals to Marv’s

Customers offering precious metals, coins, jewellery or collectibles for sale must have lawful ownership of the items and the authority to sell them.

We may request identification, examine merchandise, verify authenticity and maintain transaction records as required by law or our legitimate fraud-prevention procedures.

Any purchase offer is subject to our assessment of authenticity, condition, purity, weight and market value.

No purchase is final until both parties have agreed to the transaction and its terms.

We reserve the right to decline suspected counterfeit, stolen, unlawfully obtained or otherwise unacceptable merchandise.

  1. Product Descriptions and Authenticity

We make reasonable efforts to accurately describe the products offered on our website.

Product photographs may be representative unless the listing specifically states that the exact pictured item will be supplied.

Random-year bullion products may vary by date, design, packaging or condition as disclosed in the product description.

Minor cosmetic variations that are consistent with the stated product grade or condition do not necessarily constitute defects.

Any express authenticity guarantees, manufacturer warranties and applicable statutory protections remain in effect.

  1. Privacy and Personal Information

We collect and use personal information as reasonably necessary to process orders, accept payments, arrange shipping, respond to inquiries, prevent fraud and comply with legal obligations.

Personal information will be handled in accordance with applicable Canadian privacy legislation, including the Personal Information Protection Act of Alberta and applicable federal legislation.

Payment information may be processed by authorized third-party payment service providers.

We do not sell customer personal information to advertisers.

Further details about information collection, disclosure, retention, safeguards and customer privacy rights should be provided in our separate Privacy Policy.

  1. Website Content and Intellectual Property

Website text, graphics, branding, photographs and other original content owned by Marv’s Precious Metals & Collectibles are protected by applicable Canadian intellectual property laws.

Visitors may use website content for lawful personal, non-commercial purposes.

Reproduction, redistribution or commercial use of our protected materials requires prior written permission, except where otherwise permitted by law.

Third-party trademarks and product names remain the property of their respective owners.

  1. Investment Risk

Gold, silver and other precious metals fluctuate in value.

Historical performance does not guarantee future results.

Information provided on our website is for general informational purposes and does not constitute personalized investment, tax or financial advice.

Customers are responsible for evaluating their own financial circumstances and investment decisions.

Nothing in this section limits liability for misrepresentation or other conduct for which liability cannot legally be excluded.

  1. Limitation of Liability

To the extent permitted by applicable law, Marv’s is not responsible for losses arising solely from changes in precious-metal market prices or from interruptions beyond our reasonable control.

We do not guarantee uninterrupted website access or error-free market-data feeds.

Nothing in these Terms and Conditions excludes or limits liability, warranties, consumer remedies or other obligations that cannot lawfully be excluded or limited.

  1. Governing Law

These Terms and Conditions are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Subject to mandatory consumer protection rules and applicable jurisdictional requirements, disputes will be addressed by the courts having lawful jurisdiction in Alberta, Canada.

Nothing in this section prevents a consumer from exercising rights available under applicable laws of their province or territory.

  1. Changes to Terms and Conditions

We may update these Terms and Conditions to reflect changes in business operations, website functionality or applicable laws.

Updated terms will be posted on our website with a revised effective date.

Changes will not retroactively alter the terms of an already accepted order without lawful authority or agreement.
